- Responsibility and Use & Disclaimer Warrenties: You are responsible for the use of the rented items. You assume all risks inherent to the use of rented items, and agree to assume the entire responsibility for the defense of, and to pay, indemnity and hold Samavana Charity harmless from and hereby release Samavana Charity from, all claims for damage to property or bodily injury (including death) resulting from the use, or possession of the items, whether or not it be claimed or found that such damage or injury resulted in whole or part from Samavana Charity Dinnerware, or any other cause.
- Use of Dinnerware: Renter agrees & covenants to be satisfied with the conditon of Dinnerware rented and the proper and safe use Dinnerware, and return the Dinnerware in as-is condition. Renter further agrees that the items will only be used at the address listed on contract, and only for the purpose for which it was intended and manufactured. Subleasing or improper use is prohibited. Renter agrees they have read all instructions related to rented items.
- Dinnerware Responsibility: Renter is responsible for Dinnerware from time of possession to time of return. Renter assumes the entire risk of loss, regardless of cause. If items are lost, stolen, damaged, renter w ill assume cost of replacemt. Renter shall pay a reasonable cleaning charge for rented items returned dirty.
- Time of Return: Renter's right of possession terminates upon the expiration of rental period set forth on the contract. Time is of the essence in this contract. Any extension must be agreed upon in writing.
- Late Returns : Renter shall return rented items to Samavana Charity on agreed upon day and time promptly or prior to expiration of rental period. If renter does not timely return, the rented item the rental rate shall continue until items are returned.
- Payment: Rental charges will be disclosed once we get the email conformation of the rental request. Renter shall pay all charges payable on this contract in advance. All communication will be via email.
- Deposit: Renter shall pay the entire cost of the rental and an additional 50% refundable security Deposit at time of reservation unless otherwise discussed with an Samavana Charity officer. If the rental needs to be cancelled for any reason after your pickup of the dinnerware the rental fees will be forefeited and the Security Deposit will be returned once the dinnerware is returned in as-is condition.If the rental item is returned late after the period set forth on the contract the additional rental fees will be deducted from the security deposit.
- Delivery & Pickup: Renter shall clean and repackage (in oringinal packaging) the rented items. Samavana Charity will not be responsible for pickup or delivery of rental dinnerware. Delivery and pickup shall be the responsibility of renter.
- Care of Dinnerware: In addition to its other obligations hereunder, Renter shall Pay a reasonable cleaning charge for items returned dirty and forefeit the security deposit Protect the rented items from weather damage, breakage, unauthorized or improper use, theft or loss while in possession of renter. Renter will be responsible for the loss or damage of the dinnerware and will bear the replacement cost. Renter also agrees to reimburse Samavana Charity for any additonal costs incurred as a reslult of undisclosed or subsurface conditions.
- Hold Harmless Agreement: Renter agrees all risk, and agrees to hold Samavana Charity and any of its staff harmless from and against any and all claims, losses, liabilities, and damage, and all costs and expenses arising directly and indirectlly at or relating to; The delivery, loading, unloading, and use of rented Dinnerware.
- Returned Checks: There will be a $35.00 charge on any returned check for any reason.
